Terms of Service

These Terms of Service ("Terms") govern your access to and use of BrokerSiteBuilder ("Service"), operated by us ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BrokerSiteBuilder provides tools to create, edit, and publish websites and related features for commercial lending professionals. We may modify, suspend, or discontinue parts of the Service at any time. We will try to give reasonable notice for material changes when practical.

2. Accounts

You must provide accurate information when you register. You are responsible for safeguarding your password and for all activity under your account. Notify us promptly at legal@brokersitebuilder.com if you suspect unauthorized use.

3. Your content and sites

You retain ownership of content you upload or publish through the Service ("Your Content"). You grant us a non-exclusive license to host, store, display, and transmit Your Content solely to operate and improve the Service for you.

You represent that you have the rights to Your Content and that it does not violate law or third-party rights. You may not use the Service to distribute malware, spam, deceptive content, or material that infringes intellectual property or privacy rights.

4. Acceptable use

  • No unlawful, fraudulent, or harmful activity.
  • No attempt to probe, scan, or test the vulnerability of our systems without authorization.
  • No scraping or automated access that overloads the Service or bypasses rate limits.
  • Compliance with applicable financial advertising and licensing rules is your responsibility.

5. Fees and payment

If we offer paid plans, fees and billing terms will be presented at purchase. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing with notice as described in your plan terms.

6. Intellectual property

The Service, including software, templates, branding, and documentation, is owned by us or our licensors. Except for Your Content and rights expressly granted in these Terms, no rights are transferred to you.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation or that the Service will meet your requirements.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF YOU HAVE NOT PAID US.

9. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we need to do so to comply with law or protect the Service. Upon termination, your right to use the Service ceases; we may delete Your Content after a reasonable period consistent with our Privacy Policy and backups.

11. Changes

We may update these Terms. We will post the revised Terms with an updated "Last updated" date. Material changes may be communicated by email or in-product notice. Continued use after changes constitutes acceptance of the revised Terms.

12. General

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless otherwise required by applicable law. If any provision is unenforceable, the remainder stays in effect. These Terms constitute the entire agreement between you and us regarding the Service.
